[entrepreneurs] Registering your trademark

Hi everyone. It's been a little while since I've posted. I've been
off working on our product line of family strengthening resources.
Those of you who have been on this group for a few years may remember
I created a Christian children's DVD titled, "The Pastor's House." It
was sort of a Christian Mr. Rogers.

Well we've decided to register the Pastor's House trademark and build
a complete product line around it. As I go through the process I
thought I'd share with the group what I learn about trademarks.

While we finish up production of our new Father-Child projects DVD, we
are publishing a free semi-monthly newsletter called "The Pastor's
House Newsletter." It contains a wide range of articles from basic
parenting, games, parent-child projects, favorite recipes,
homeschooling tips, faith lessons, courtship, marriage issues,
entrepreneurship - virtually anything relating to Christian parents
and the Christian family.

So what have I learned so far regarding trademarks? First, before you
can use the circle-R symbol on your trademark you must fully complete
the process and have received the registration certificate from the US
Patent and Trademark office. Until that time you must use the TM
symbol. TM simply means you consider the mark your private trademak,
but it really gives you little protection from someone else using your
mark.

Before you can register a trademark you must have more than one
product using the mark in commerce. Unlike copyrights, trademarks are
for real products that have already been sold in the marketplace. In
our case we had the one DVD and one Bible study that we used the
trademark on, so we were able to proceed with registration. We could
have had two or more DVDs, two or more books, two or more CDs, etc. or
any combination, just as long as there are at least two products on
which we used the mark.

Next you have to decide what class or classes you want the trademark
registered in. A class is a description of the type of product you
are registering. For example one of the classes we registered in is
International Class 009: DVDs featuring family entertainment of a
religious nature.

This class is broad enough to cover the original series that is aimed
at families with younger children 10 and under as well as our new
series which is aimed at families with children from 6-16.

The more classes you register in the better your mark is protected.
Of course, there is a charge for each class in which you register.
