[entrepreneurs] Re: Patented Product Manufacturing

Karmen,

I would expect fashions to be copyrighted, or possibly trademarked,
but not patented.

As for "simple, everyday products", they have to be both novel and
"not obvious to one skilled in the art". In other words, a fork with
five tines might be novel, but it isn't patentable. On the other hand,
a cross between a fork and a spoon IS patentable (or at least it was
when it was first invented).

A GOOD patent researcher will help you decide whether it's possible to
patent your invention, and will be honest about telling you when it isn't.

Also, be aware that there are several reasons to patent an invention.
One is to secure a monopoly on a product you are manufacturing.
Another is to license the invention to other companies, so they can
manufacture it and you collect the royalties. Still another is to
PREVENT someone else from manufacturing a product.

Once you HAVE a patent, it's only as good as your legal team. It's up
to YOU to identify possible infringers, to negotiate license fees, and
to pursue legal remedies in court. Otherwise the patent is pretty
worthless.
